Terms of Service

These Terms of Service ("Terms") govern your use of the OrderIt restaurant management platform ("Service") operated by OrderIt ("we," "us," or "our"), accessible at orderitnow.in. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Service" refers to the OrderIt platform, including the web application, APIs, public-facing pages, and all related features.
- "User" or "You" refers to any individual or business entity that registers for or uses the Service.
- "Restaurant" refers to the food service establishment you register and manage on the platform.
- "Customer" or "Diner" refers to end-users who place orders, make reservations, or interact with your restaurant through the Service.
- "Content" refers to all information, text, images, menus, logos, QR codes, and data uploaded to or generated through the Service.
- "Staff Links" refers to token-based access URLs generated for kitchen displays, delivery panels, waiter handhelds, and waiter kiosks that allow access without login.
2. Eligibility
You must be at least 18 years of age and have the legal authority to enter into a binding agreement to use this Service. By using OrderIt, you represent that you have the right to operate or manage the restaurant registered on the platform. You must hold all necessary food safety licenses (such as FSSAI) and comply with local regulations. We reserve the right to refuse service to anyone for any reason at any time.
3. Account Registration and Onboarding
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account, including actions taken through Staff Links you generate.
- You must verify your email address via OTP before accessing the platform.
- Upon first login, you must complete the onboarding process (business information, payment setup) before accessing the dashboard. The onboarding screen appears only once and cannot be skipped.
- You must notify us immediately of any unauthorized use of your account.
- One restaurant per account. Additional restaurants require separate accounts.
4. Service Description
OrderIt provides a cloud-based restaurant management platform that includes:
- Menu management with categories, dishes, pricing, variants (Half/Full/Quarter), and stock toggling
- Bulk menu import via Excel (.xlsx) or CSV files
- Counter-based point-of-sale (POS) for creating dine-in, pack (takeaway), and delivery orders
- QR code-based table ordering with multi-order sessions and combined billing
- Table management with floor view, zones, vacancy tracking, and per-table QR codes
- Order management with pending, preparing, prepared, and completed statuses
- Delivery management with order tracking, delivery charge slabs, and delivery panel for staff
- Kitchen Display System (KDS) for real-time order visibility on kitchen TVs/tablets
- Waiter's Handheld — per-waiter tablet/phone kiosk links for taking orders and managing tables
- Waiter calling system — customers can call waiters from QR ordering pages
- Website Builder with three templates (Classic, Modern, Elegant), gallery, operating hours, social links, and special offers
- Public restaurant profile page with online menu, ordering, and table reservations
- Table reservation system with advance payments via UPI
- UPI payment integration (Google Pay, PhonePe, Paytm, etc.) with QR code display
- Invoice and bill generation with restaurant branding (logo, GST, FSSAI), downloadable eBills, and "BILL PAID" stamps
- Direct thermal receipt printing via WebUSB for 58mm and 80mm ESC/POS thermal printers
- Analytics dashboard with revenue charts, order trends, payment breakdowns, and best-selling dishes
- Real-time order notifications with sound alerts and browser push notifications
- Feature toggles to enable/disable individual modules
- Subscription management with tiered plans (Starter, Growth, Pro)
Features available to you depend on your subscription plan tier. We reserve the right to modify, add, or remove features at any time with reasonable notice.
5. Subscription Plans and Billing
- Access to OrderIt requires an active paid subscription after any applicable free trial period.
- We offer three plan tiers: Starter, Growth, and Pro. Each tier unlocks progressively more features.
- Billing cycle: A "month" on OrderIt is defined as 28 days (not a calendar month). Monthly subscriptions renew every 28 days from the date of purchase.
- Free trial periods, if offered, are defined per plan and subject to the same 28-day cycle. Trial access grants full features of the selected plan tier for the trial duration.
- Subscription plans and pricing are displayed on the platform and may be updated from time to time. Price changes do not affect active billing cycles — they apply at the next renewal.
- Payments are processed securely through Cashfree payment gateway. By subscribing, you also agree to Cashfree's terms of service.
- Subscriptions renew automatically unless cancelled before the renewal date. You may cancel auto-renewal at any time from the Subscription page.
- Failure to pay may result in suspension of your account. Your data will be preserved for 30 days, during which you may renew to restore access.
- When your subscription expires, your QR codes, public profile, and all customer-facing features will display a "Service Unavailable" message. Your data is not deleted.

6. Payment Processing (UPI)
OrderIt facilitates UPI-based payments between your customers and your restaurant. Important clarifications:
- Customer payments go directly to your UPI account. OrderIt does not hold, process, or intermediate customer payments at any point.
- You are responsible for providing accurate UPI ID, QR code, and payment contact information. Incorrect details may result in payments not reaching your account.
- OrderIt does not automatically verify UPI payments. You must manually verify each payment through your bank or UPI app before confirming the order.
- We are not responsible for any payment disputes, failed transactions, or lost funds due to incorrect UPI details provided by you.
- For table reservations with advance payments, the same direct UPI model applies — we do not hold or escrow reservation fees.
7. User Responsibilities
As a user of OrderIt, you agree to:
- Use the Service only for lawful purposes related to restaurant management
- Provide accurate and truthful information about your restaurant, including menu items, pricing, tax details (GST/FSSAI), and contact information
- Comply with all applicable local, state, and national laws and regulations, including food safety, licensing, and tax requirements
- Maintain accurate GST and FSSAI numbers if you display them on invoices — we do not verify these numbers
- Verify all UPI payments manually before confirming orders or releasing food
- Manage Staff Links (kitchen display, delivery panel, waiter handhelds) responsibly — regenerate or delete links when staff leave to revoke access
- Keep your menu, pricing, and stock status up to date so customers see accurate information
- Not upload any content that is illegal, harmful, threatening, abusive, or infringes on intellectual property rights
- Not attempt to gain unauthorized access to the Service, other accounts, or our systems
- Not use the Service to transmit spam, malware, or other harmful content
- Not reverse-engineer, decompile, or attempt to extract the source code of the Service
- Not share, resell, or sublicense your account or subscription to third parties
8. Content Ownership
A. Your Content
You retain ownership of all content you upload to the Service, including menus, images, logos, restaurant details, and invoice settings. By uploading content, you grant OrderIt a non-exclusive, worldwide license to use, display, and distribute that content solely for the purpose of providing the Service (e.g., displaying your public profile page, generating invoices, printing thermal receipts, and showing your menu to customers via QR codes).
B. Our Content
The OrderIt platform, including its design, code, features, templates, logos, and branding, is the intellectual property of OrderIt. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
C. Generated Content
QR codes, invoice PDFs, eBill images, and kitchen/delivery/waiter panel pages generated by the Service are provided for your operational use. You may print, share, and distribute these materials in connection with your restaurant operations.
9. Public Profile and Website
When you enable a public profile and/or Website Builder for your restaurant, certain information becomes publicly accessible at your unique OrderIt URL. This may include your restaurant name, address, phone number, menu, photos, gallery images, operating hours, social media links, special offers, and reservation availability. You are solely responsible for the accuracy and legality of information displayed on your public profile. You may disable the public profile at any time through your settings, which immediately hides all public-facing content.
10. Staff Access Links
OrderIt allows you to generate token-based URLs for staff access (Kitchen Display, Delivery Panel, Waiter Panel, Waiter's Handheld). These links grant access to specific operational features without requiring login credentials. You are responsible for:
- Distributing Staff Links only to authorized personnel
- Regenerating or deleting links when staff members leave or access should be revoked
- Understanding that anyone with a valid Staff Link can access the associated features
- Any actions taken through Staff Links, including order modifications, status changes, and bill operations
11. Thermal Printing and Device Access
OrderIt supports direct thermal receipt printing via the WebUSB browser API. When you connect a USB thermal printer:
- Your browser will request permission to access the USB device. This permission is granted by you and can be revoked at any time through browser settings.
- Printer configuration (paper width, auto-cut preference) is stored locally in your browser's localStorage — it is not transmitted to our servers.
- We support standard ESC/POS protocol compatible with most 58mm and 80mm thermal printers (Epson, Star Micronics, XPrinter, and similar brands). We do not guarantee compatibility with all printer models.
- WebUSB is only supported in Chrome and Edge browsers. Other browsers will fall back to standard browser print dialogs.
12. Bulk Menu Import
You may import menu data in bulk via Excel (.xlsx) or CSV files. You are responsible for the accuracy of imported data, including dish names, prices, categories, and variants. Bulk import adds new items to your existing menu — it does not delete or overwrite existing items. Duplicate category names are merged automatically (case-insensitive).
13. Tax and Invoice Compliance
- OrderIt provides tools to configure taxes (GST, CGST, SGST, service charges, VAT, etc.) and generate branded invoices. These are provided as convenience tools only.
- You are solely responsible for the correctness of your tax configuration, GST numbers, FSSAI numbers, and all information displayed on invoices.
- OrderIt does not file taxes on your behalf, does not verify your GST or FSSAI registration, and does not provide tax advice.
- You must comply with all applicable tax laws and regulations in your jurisdiction.
- Invoices generated by OrderIt are not certified GST invoices unless your tax configuration and business registration support that claim.
14. Limitation of Liability
To the maximum extent permitted by law:
- OrderIt is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- We are not liable for any payment disputes, failed UPI transactions, incorrect tax calculations, or financial losses arising from use of the Service.
- We are not liable for any unauthorized access resulting from Staff Links that you failed to revoke.
- Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
- We are not responsible for any loss of revenue, data, or business opportunities resulting from use of the Service.
15. Indemnification
You agree to indemnify, defend, and hold harmless OrderIt, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, incorrect tax or invoice information, UPI payment disputes, or your violation of any applicable laws or regulations.
16. Service Availability and Modifications
- We strive to maintain high availability but do not guarantee 100% uptime.
- We may perform scheduled or emergency maintenance that temporarily affects access.
- We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice.
- Feature availability may change across plan tiers. If a feature you use is moved to a higher tier, you will be notified and given time to upgrade or adjust.
- In the event of a permanent discontinuation of the Service, we will provide at least 30 days' notice and allow you to export your data.
17. Termination
We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent, illegal, or abusive activity, or fail to maintain an active subscription for more than 30 days. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, during which you may request an export. After 30 days, we may permanently delete your data unless retention is required by law.
You may terminate your account at any time by contacting support or using the account deletion option in Settings. Termination does not entitle you to a refund for any remaining subscription period.
18. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India. We encourage you to contact us first to resolve disputes informally before pursuing legal action.
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the platform. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with updated Terms, your remedy is to stop using the Service and cancel your subscription.
